Terms of service

These Terms of Service ("Terms") are a binding agreement between you and SyncFac (Pty) Ltd ("we", "us", "our"), the company that operates WebTrack, governing your access to and use of the WebTrack application, its tracking script and server interface, and this website (together, the "Service").

By accessing or using the Service you confirm that you have read and agree to these Terms. If you are using the Service for an organisation, you confirm that you have authority to bind that organisation.

WebTrack is provided free of charge to the businesses whose websites we build or look after. We set up each organisation and invite its first members, and there is no fee, subscription or payment.

Because the Service is free, we may change what it includes, or stop offering it, with reasonable notice. If we stop offering it, we will give you time to save the reports you need.

You are responsible for your credentials and for everything that happens under your account. Use a strong, unique password, do not share it, and tell us immediately if you suspect unauthorised access.

Organisation owners and admins decide who has access. Owners invite admins and viewers, change other members’ roles, revoke invitations and remove any member except themselves and the last owner. Admins can invite and remove viewers and revoke viewer invitations. Removing someone’s access when they no longer need it is your responsibility, and WebTrack gives you the tools to do it.

We may suspend or close an account or an organisation that breaches these Terms or puts the Service or other organisations at risk.

You can stop using WebTrack at any time. To leave an organisation, ask one of its owners to remove you, or ask us. An owner cannot remove themselves, so an owner who wants to leave should ask another owner or us.

To have your account deleted, or to close your organisation, email hello@syncfac.com. We delete the account or the organisation’s data within 30 days of the request, as our Privacy Policy describes.

You decide which websites WebTrack measures, and you are responsible for telling the visitors of those websites about it in your own privacy notice, and for any consent the law requires of you.

• Do not put personal information, such as names, email addresses or ID numbers, in page paths, campaign labels, event names or server reports
• Keep server keys secret and on your own server, never in a web page
• Only report a purchase or refund after your own payment provider has confirmed it

For the visits WebTrack records on your websites, you are the responsible party and we are your operator, as POPIA sections 20 and 21 describe. We:

• Process that information only on your documented instructions, which are the Service as these Terms, our Privacy Policy and the developer guide describe it, and never for a purpose of our own
• Keep it confidential, and let only the people who run and support the Service see it
• Protect it with appropriate measures: visit identifiers hashed with a secret key, no stored IP addresses, access by role, encryption in transit (TLS), and passwords and secrets stored only as hashes
• Tell you without undue delay if we have reasonable grounds to believe that it has been accessed or acquired by someone without authority
• Delete it when you delete the website, or within 30 days of your request when your organisation leaves WebTrack

You must not:

• Use the Service in a way that breaks any applicable law or regulation
• Attempt to gain unauthorised access to the Service, another organisation’s data, or related systems
• Interfere with or disrupt the Service, or circumvent rate limits and access controls
• Send false or misleading visits or events, or measure a website you have no right to measure
• Use the Service to identify or track individual people
• Resell or redistribute the Service without our written permission

The analytics for your websites belong to you. You grant us a non-exclusive licence to host, store and process them solely to provide the Service to you and as our Privacy Policy describes. The Overview and Acquisition reports export to CSV for the period on screen, and we will provide anything else on request.

An owner of your organisation can delete a website, and everything WebTrack recorded for it, at any time. The deletion is immediate and permanent: the website’s visits, events, revenue records, goals, funnels and server key are removed and cannot be restored, so export anything you want to keep first. Admins can change a website’s name and domain but cannot delete it.

The Service, including its software, design, branding and documentation, belongs to SyncFac (Pty) Ltd and is protected by copyright, trade mark and other laws. You may not copy, modify, distribute, reverse engineer or create derivative works from it without our written permission.

If you send us feedback or suggestions, we may use them without obligation to you.

We work to keep the Service available and will give notice of planned maintenance where we reasonably can. The Service is provided "as is", and we do not warrant that it will be uninterrupted, error-free or that every visit will be recorded.

The Service is free, and our liability reflects that. To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, including loss of profits, revenue or data, business interruption, or decisions made on the strength of a report, and our total liability to you for all claims arising from the Service is limited to R1,000.

Nothing in these Terms limits liability for fraud, gross negligence or wilful misconduct, or any other liability that cannot lawfully be limited.

We may revise these Terms by publishing an updated version. Material changes will be communicated in WebTrack or by email at least 30 days beforehand. Continuing to use the Service after that means you accept the revised Terms.

These Terms are governed by the laws of the Republic of South Africa. Disputes will be resolved in the courts of South Africa, unless we both agree in writing to arbitration.

• These Terms and the Privacy Policy are the entire agreement between us regarding the Service
• If a provision is found unenforceable, the rest continues in full force
• A failure to enforce a right is not a waiver of it
• You may not assign your rights without our written consent; we may assign ours on notice

WebTrack is operated by SyncFac (Pty) Ltd, a private company registered in South Africa. Questions about these Terms can go to the address below. Our company registration number and physical address are available on request from the same address.
